Court Approved Payment Plans
Prior to filling out the Court's Installment Payment Agreement (provided below in Supporting Documents), you will need to contact the Justice Court to ensure that you are eligible to enter into a court approved payment plan and, if so, the amount of money required by the Court to start your payment plan. The Court requires everyone to pay a one time $20 administrative fee and the first payment to start the payment plan. If your fine is past due, the Court will require you to pay half of the fine owing as your first payment. Once you have contacted the court and received your information you may print out the Affidavit of Income and Assets. You must do the following:
- Fill out the top portion of the affidavit completely; if an item does not apply, please right "none". Do not write N/A.
- Sign the affidavit before a Notary Public (Most banks have a Notary Public available to witness your signature for a small fee).
- Return the entire form to the Deschutes County Justice Court, along with a check or money order, for the total amount the Court Clerk told you by the fine due date you received by the court. If the fine due date falls on a holiday or weekend, the payment must be receipted by the Court on the business day PRIOR to that date. We do not go by postmark dates.
The Court will return your copy of the form showing that your monthly payments begin 30 days from the date we file the agreement. If your fine was past due we will also enclose a license clearance form, which you can take directly to an Oregon DMV office to update their records.
IMPORTANT
This agreement will not go into effect, and the Court will proceed with collection action, if any of the following occurs:
- The payment agreement is not completely filled out and notarized; or
- You fail to enclose the required amount of money.
