Proposal Summary

Location
The proposed City of Mountain View extends west at Diamond T Road and ends in the east at the intersection of Highway 20 and 27. It consists of approximately 265 square miles or 169,550 acres.
Background
A petition has been filed for the incorporation of a new city in Deschutes County. The Board of County Commissioners (Board) is required to hold a public hearing to determine whether to place the proposed incorporation on the May 2024 ballot per ORS 221.040(3). To determine whether the incorporation should be placed before the voters, the Board must determine:
- Whether the proposed boundary correctly includes all lands that would be benefited from being in the proposed city.
- Whether the taxation rate will support the proposed services.
- Whether the proposed city can and will be able to comply with relevant statewide planning goals, County Comprehensive Plan goals and policies, and implementing ordinances.
The first two issues are required by ORS and the third is related to land use and is required by OAR and 1000 Friends of Oregon v. Wasco County Court, 299 Or. 344, 358-60, 67 (1985).
Proposal Status
The Board of County Commissioners held a public hearing on Wednesday, September 20, 2023. Following petitioner, agency, and public testimony, the Board closed the hearing and deliberated on the matter.
The Board voted 3-0 to deny the proposed petition to incorporate. The decision was formally signed and mailed on September 28, 2023. No appeal was filed with the Land Use Board of Appeals, therefore the decision is final as of October 19, 2023.
