Marijuana Text Amendments

Since the release of the Marijuana Regulatory Assessment on April 2, 2018, the Board of County Commissioners has conducted numerous work sessions to discuss programmatic changes to the regulation and enforcement of marijuana production on rural lands based on the Board’s ensuing experience with marijuana production sites since the original regulations were adopted in 2016.

LATEST UPDATES

September 3, 2019: The Board of County Commissioners adopted Ordinance No. 2019-012, repealing Ordinance No. 2018-012 (marijuana text amendments) in its entirety.

August 19, 2019: The Board of County Commissioners voted unanimously and by emergency to temporarily opt out of the establishment of future marijuana production and processing businesses, until the matter is referred to Deschutes County voters in the next statewide general election (November 3, 2020). Effective immediately, no new applications for marijuana production or processing will be accepted by CDD until the matter is voted upon on November 3, 2020. July 3, 2019: The Board of County Commissioners held a public hearing for the reconsideration of Deschutes County's marijuana text amendments on July 3, 2019. Information regarding the hearing and links to associated documents are posted below. An open record period for written testimony was available until July 21 at 11:59 PM. All documents submitted during the open record period are provided below. 

February 28, 2019: Deschutes County filed a Notice of Withdrawal of the adoption of Ordinance No. 2018-012. A public hearing will be held to reconsider the proposed text amendments at a date to be determined. Public notice for the hearing will be provided per the requirements of Deschutes County Code.

November 14, 2018: Deschutes County received an appeal to the Land Use Board of Appeals of Ordinance No. 2018-012. 

October 24, 2018: Ordinance No. 2018-012, consisting of changes to the Deschutes County Code concerning the regulation and enforcement of marijuana production on rural lands, was signed by the Board of County Commissioners on October 24, 2018. The effective date of the new regulations is November 23, 2018. Applications submitted beginning November 26, 2018 must comply with the new regulations.
